Zintenzívnené kontroly nelegálnej práce a nelegálneho zamestnávania

Národný inšpektorát práce avizuje zvýšené kontroly nelegálnej práce a nelegálneho zamestnávania. 

Medzi hlavné priority Národného inšpektorátu práce pre rok 2026 majú patriť v súvislosti s dodržiavaním zákazu nelegálnej práce a nelegálneho zamestnávania tiež kontroly tzv. „fiktívnych živnostníkov“ a zamestnávania štátnych príslušníkov tretích krajín. S tým súvisí aj kontrola poskytovania služieb prostredníctvom týchto osôb vrátane dočasného prideľovania zamestnancov.

Počas mesiaca február 2026 sa uskutočnili kontroly zamerané na agentúry dočasného zamestnávania a užívateľských zamestnávateľov a podľa zverejnených informácií majú mimoriadne a nárazové kontroly inšpektorátov práce pokračovať aj v ďalšom období.

Kontroly súvisia aj so zmenou Zákonníka práce účinnou od 1. januára 2026, v ktorej dôsledku došlo k zmene definície závislej práce.

Odporúčame venovať zvýšenú pozornosť pri využívaní rôznych foriem spolupráce so živnostníkmi, alebo využívaní práce pracovníkov formou dočasného prideľovania vrátane preverovania dokumentácie, a to nielen v súvislosti s prebiehajúcimi kontrolami.​


Verstärkte Kontrollen illegaler Arbeit und illegaler Beschäftigung

Das Nationale Arbeitsinspektorat kündigt verstärkte Kontrollen illegaler Arbeit und illegaler Beschäftigung an.

Zu den Hauptprioritäten des Nationalen Arbeitsinspektorats für das Jahr 2026 gehören im Zusammenhang mit der Einhaltung des Verbots illegaler Arbeit und illegaler Beschäftigung auch Kontrollen von sog. „Scheinselbstständigen” und Beschäftigung von Drittstaatsangehörigen. Damit verbunden ist auch die Kontrolle der Erbringung von Dienstleistungen durch diese Personen, einschließlich der vorübergehenden Überlassung von Arbeitnehmern.

Im Februar 2026 wurden Kontrollen mit Schwerpunkt auf Zeitarbeitsagenturen und Entleiher durchgeführt. Nach den veröffentlichten Informationen sollen die außerordentlichen und stichprobenartigen Kontrollen der Arbeitsaufsichtsbehörden auch in nächster Zeit fortgesetzt werden.

Die Kontrollen hängen auch mit der Änderung des Arbeitsgesetzbuches zusammen, die am 1. Januar 2026 in Kraft getreten ist und aufgrund welcher sich die Definition der abhängigen Arbeit geändert hat.

Bei der Zusammenarbeit mit Selbstständigen oder bei der vorübergehenden Arbeitnehmerüberlassung, einschließlich der Überprüfung von Unterlagen, empfehlen wir erhöhte Aufmerksamkeit, und zwar nicht nur im Zusammenhang mit den laufenden Kontrollen.​


Intensified inspections of illegal work and illegal employment

The National Labour Inspectorate has announced an increase in inspections relating to illegal work and employment.

In 2026, the National Labour Inspectorate's main priorities in relation to compliance with the ban on illegal work and employment will include inspections of so-called 'fictitious self-employed persons' and the employment of third-country nationals. This will include checks on services provided by these individuals, including temporary employee assignments.

In February 2026, inspections targeting temporary employment agencies and user employers were carried out, and according to published information, extraordinary and spot checks by labour inspectorates are set to continue in the near future.

These inspections are also related to the amendment to the Labour Code, which came into effect on 1 January 2026 and changed the definition of dependent work.

We recommend paying increased attention to various forms of cooperation with self-employed persons, as well as to the work of temporary workers, including checking documentation. This should be done not only in connection with ongoing inspections, but also at other times.​​​
